These Terms of Use ("Terms") are issued by Charred Oaks Digital, LLC, the owner and operator of Moundball ("App"). Charred Oaks Digital, LLC ("we," "us," or "our") provides the Moundball application and related services ("Services"). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. ELIGIBILITY & ACCOUNT REGISTRATION
You must be at least 18 years old (or the legal age in your jurisdiction) to use Moundball.
To use Moundball, you must create an account and verify your phone number via One-Time-Password authentication. Without an account, you will not be able to access the App.
Users must provide accurate information when creating an account and keep their login credentials secure.
Users acknowledge that their mobile number will be used for One-Time-Password authentication and account verification to ensure security and prevent unauthorized access.
We reserve the right to suspend or terminate accounts with inaccurate or fraudulent information.
2. USER CONDUCT & RESPONSIBILITIES
Users must engage in fair play and avoid cheating, exploiting bugs, or manipulating results.
Harassment or inappropriate behavior will result in suspension or termination.
Users are responsible for ensuring they comply with all applicable laws when using the App.
3. MOUNDBUCKS POINTS
Moundbucks are a virtual in-game points system with no monetary value.
We reserve the right to modify how Moundbucks are earned and used in the App.
4. TERMINATION & SUSPENSION
We reserve the right to suspend or terminate any user’s account for violating these Terms.
If an account is suspended or terminated, any remaining Moundbucks and game history may be deleted and cannot be recovered. Personal data will be handled in accordance with our Data Policy.
5. LIMITATION OF LIABILITY & DISCLAIMERS
Moundball is an entertainment app designed for scorekeeping and interactive gameplay. It does not involve real-money betting or gambling. Moundball is not responsible for:
Technical failures, connectivity issues, or service interruptions.
Loss of Moundbucks due to system errors, account suspensions, or other unforeseen circumstances.
Any legal consequences of using the App in locations where similar games may be restricted.
6. INTELLECTUAL PROPERTY & LICENSE
Charred Oaks Digital LLC own the intellectual property rights for all material on App. All intellectual property rights are reserved. You may access Moundball for your own personal use subject to restrictions set in these Terms.
You must not:
Copy, modify, or republish material from Moundball.
Sell, rent, or sub-license material from Moundball.
Reproduce, duplicate, or copy material from Moundball.
Redistribute content from Moundball.
All content, trademarks, and branding within Moundball are the property of Charred Oaks Digital, LLC. Users may not copy, modify, distribute, or exploit any part of the App without prior written consent.
7. PRIVACY & DATA HANDLING
We collect and store user data in accordance with our Data Policy.
Personal data is not sold to third parties.
Users may request a copy of their data or deletion of their account by contacting support@moundball.app.
8. COOKIES
The website uses cookies to help personalize your online experience. By accessing Moundball, you agreed to use the cookies.
We may use cookies to collect, store, and track information for statistical or marketing purposes to operate our website.
9. UPDATES & MODIFICATIONS
We may update these Terms at any time. Continued use of the App after updates means you accept the revised Terms.
Significant changes will be communicated via the App or email. By continuing to use the App after updates, you agree to the revised Terms.
10. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of Missouri, United States.
Users outside of Missouri acknowledge that local laws may differ but agree to resolve disputes under Missouri jurisdiction.
Disputes shall be resolved through arbitration or mediation before pursuing litigation.
